General terms and conditions of business

1. Obligations prior to the start of the procurement procedure

This document sets out the General Terms and Conditions of Contract governing the sale of products PLANISFERIO EDICIONES S.L. (hereinafter, the “PUBLISHER”) through the website www.planisferio.es (hereinafter, the “WEBSITE”).

The use of the WEBSITE and the purchase of products through it implies the free acceptance of these General Terms and Conditions, as well as our Privacy Policy and Cookies Policy (hereinafter, “Terms and Policies”), which may be consulted on this WEBSITE. In case of discrepancy with these Conditions and Policies, you should refrain from purchasing any product on our WEBSITE.

This document sets out the General Terms and Conditions governing the sale of products PLANISFERIO EDICIONES S.L. (hereinafter the “PUBLISHER”) through the website www.planisferio.es (hereinafter the “WEBSITE”).

The use of the WEBSITE and the purchase of products through it implies the free acceptance of these General Terms and Conditions, as well as our Privacy Policy and Cookies Policy (hereinafter, “Terms and Policies”), which may be consulted on this WEBSITE. In case of discrepancy with these Conditions and Policies, you should refrain from purchasing any product on our WEBSITE.

These Terms and Policies abide by the provisions of the regulations cited:

Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights.

European Regulation 679/2016 on Personal Data Protection.

Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.

Law 34/2002, of July 11, 2002, on Information Society Services and Electronic Commerce.

Law 7/1998, of April 13, 1998, on General Contracting Conditions.

In any case, the Conditions and Policies may be modified at any time.

It is the responsibility of the CLIENT to review them before doing so.

The Conditions and Policies in force at the time of using the WEBSITE will be those applicable to the contract.

2. Identification of the contracting parties

On the one hand, PLANISFERIO EDICIONES S. L., with registered office at Brasil 1 – 6ºD, 36204 VIGO (SPAIN) and on the other hand, the CLIENT or purchaser of the products of the PUBLISHER, whose personal data is provided through the form provided by the PUBLISHER on its WEBSITE, for the purchase of its products.

The CUSTOMER can consult the treatment of their data in our Privacy Policy.

The CLIENT is considered to be any natural person of legal age and with full legal capacity to enter into obligations and any legal person purchasing through a legal representative or a person with sufficient power to enter into this contract.

3. Object and nature of the contract

The PUBLISHER has a WEBSITE through which it offers and sells books exclusively to the CLIENT. The marketing of books through the WEBSITE is intended only for the end CUSTOMER, under the provisions of Royal Legislative Decree 1/2007 of November 16, 2007, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter TRLGDCU).

It is therefore strictly forbidden to resell the products offered by the PUBLISHER purchased through the WEBSITE, expressly insisting that sales are always to the consumer and end user.

According to what has been expressed, the purpose of the contract is to regulate the commercial relations generated between the PUBLISHER and the CUSTOMER who purchases products from the PUBLISHER through the WEBSITE.

The General Terms and Conditions are an essential part of the contract, a copy of which will be given to the CUSTOMER.

4. Purchase and sale system

4.1 Product

The PUBLISHER offers limited editions of books on paper, visible in its Virtual Catalog available on the WEBSITE.

The PUBLISHER ensures that the images correctly identify the books, so that the CUSTOMER can get a correct idea of their characteristics.

The CUSTOMER must make sure that the requested book corresponds to the corresponding image on the WEBSITE.

Should any doubts arise or should the CLIENT wish to request any clarification or make any suggestions or have any questions, he/she may contact the Customer Service Department, as indicated in the ninth clause.

4.2 Price

The PUBLISHER mentions in the description of each book its final price (RRP) expressed in Euros.

The price will be the one in force at the moment of the purchase by accepting the contents of the shopping cart and proceeding with the payment.

The PUBLISHER reserves the right to modify the price at any time, and no claims will be admissible for this circumstance.

4.3 Tax

The price includes Value Added Tax (VAT).

In accordance with the provisions of Article 68 of Law 37/1992 of 28 December 1992 on Value Added Tax, it is understood that the delivery of the product is located in the territory of application of Spanish VAT.

The applicable VAT rate shall be the rate legally in force at any given time (currently 4%).

4.4 Shipping Costs

Shipping costs are included in the price.

4.5 Product invoicing and purchase confirmation

The PUBLISHER guarantees the total security of the payment transaction with the CUSTOMER, in addition to having the latest technological standards in terms of payment security protocols and services.

The PUBLISHER expressly provides an email that the EDITORIAL will send to the customer containing all the information related to the order, including the total price and the postal address provided by the customer, where the delivery will take place once the order has been placed.

Regarding the method of payment for products purchased through the WEBSITE, the following alternative is offered:

1. Bank transfer. In this case, it will be provided to the CUSTOMER by email and must be made within 7 calendar days from the day following the sending of the aforementioned email.

2. Bizum. Under the same conditions as point 1 above.

3. Virtual POS by credit card VISA or Mastercard through the payment gateway using the secure SSL protocol of the entity Banco Sabadell S. A.

The PUBLISHER will consider the purchase of the products effective once the confirmation from the bank has been received.

If the product purchase process is interrupted for any reason or if the required amount is not satisfied (including management fees and bank charges), the PUBLISHER will suspend the product purchase process and will inform the customer about it.

4.5 Delivery

4.5.1 Availability

The PUBLISHER always guarantees the existence in stock of the purchased title.

In the event that the PUBLISHER does not deliver the product claiming that it is not available, it will compensate the CUSTOMER by paying double the price paid by the CUSTOMER.

4.5.2 Delivery time

Except in case of force majeure, under the terms indicated in clause 8, the PUBLISHER undertakes to make the product available to the customer within a maximum period of thirty calendar days from the day following the payment of the price.

The PUBLISHING COMPANY will communicate to the customer, if necessary, the existence of any causes that may prevent the fulfillment of the above deadline.

The PUBLISHER declines any responsibility for delays due to causes attributable to the CUSTOMER, including being absent at the time of delivery and, similarly, for those due to the company providing the delivery service.

The CUSTOMER will receive by e-mail the summary of the order placed and with the payment confirmation.

4.5.3 Home delivery conditions

The PUBLISHER guarantees the reception of the product in proper condition.

The products are sent by Sociedad Estatal Correos y Telégrafos S. A. (Correos), according to the formalities and protocols established in each case.

4.6 Cancellation of purchase

THE PUBLISHER reserves the right to remove any product from the WEBSITE at any time and to alter any material or content.

In any case, the PUBLISHER will not be liable to the customer, or to any third party, for removing any product from the website or for the cancellation of orders despite having sent confirmation of purchase, although it will always have to inform about this situation to the customer.

4.7 Territories

The PUBLISHER agrees to distribute its products purchased through its WEBSITE in the following territories:

1. Europe: all countries except the Russian Federation.

2. Americas: all countries.

3. Asia: Israel, Japan, South Korea and the Philippines.

4. Oceania: Australia and New Zealand.

However, the PUBLISHER reserves the right not to accept orders arriving from countries where there are circumstances that do not guarantee the security of the shipment, all in accordance with the provisions of clause 8 of these General Terms and Conditions.

The person who lives in other countries and is interested in purchasing a product, may send an email to p@planisferioediciones.es obtaining a subsequent response from the PUBLISHER in the appropriate sense.

5. Contracting procedure

Pursuant to Article 23 of Law 34/2002, of July 11, 2002, on Information Society Services and Electronic Commerce, contracts agreed by electronic means are fully effective, provided that they contain consent, object, cause and other legal requirements.

The tenor of these General Contracting Conditions is always available to the general public and, particularly, to the CUSTOMER, who must expressly accept them when placing the order.

The purchase shall be deemed to take place at the precise moment when the CUSTOMER clicks on the option “Confirm / Pay / Agree” in the payment gateway, being then when all phases of the electronic contracting procedure are understood to be completed.

The provision of all required data in the form implies the implicit willingness of the CUSTOMER to accept these General Terms and Conditions.

The EDITORIAL, as an information society service provider, will store the electronic document that formalizes this contract. This electronic document, as well as the generated purchase invoice, will be sent to the email provided by the CUSTOMER during the contracting process.

The language of the contracting procedure is Spanish.

6. Withdrawal

According to the provisions of Article 102 of the TRLGDCU, the customer may exercise its right of withdrawal within a maximum period of 14 days from the time of receipt of the product.

6.1 refund procedure for withdrawal:

1. The CUSTOMER must inform the PUBLISHER of its desire to withdraw and return the book by sending an email to p@planisferioediciones.es.

2. The CUSTOMER must send the book in the same condition in which it was delivered and without signs of tampering to the address that will be provided once the return request has been sent and within 20 days from the day following the day of the email in which the CUSTOMER informs the PUBLISHER of his will to return the book.

3. If the PUBLISHER considers that the book has been subject to any kind of use or manipulation or if it finds any damage to the returned product, it reserves the right to send it back to the customer, who will be responsible for the shipping costs.

4. The customer assumes the cost of returning the book.

except in case of error in the shipment of the damaged order. In this case, the costs and/or costs of return will be borne by the PUBLISHER provided that the return has been carried out in accordance with the return instructions provided by the PUBLISHER.

5. The PUBLISHER will refund the amount paid by the customer in the purchase process through the payment method used by the customer in the initial transaction within a maximum period of 15 days, once the PUBLISHER has received the book.

7. Damages and defects

In case the CUSTOMER receives a damaged or defective product or if some of the ordered products are not delivered, the CUSTOMER must immediately inform the PUBLISHER through the means indicated in clause 9.

The PUBLISHER will proceed to resolve the contingency as soon as possible and at its own expense, provided that the incident is attributable to it.

The return will not involve any cost for the CUSTOMER.

8. Customs

The CUSTOMER shall be solely responsible for the delivery of products that may be retained by customs authorities in countries outside the EU, as well as for the payment of any applicable taxes.

9. Force majeure

The following are cases of force majeure, among others:

1. Events that are impossible to predict or that, being foreseeable or foreseen, were unavoidable.

2. Damage caused by third parties.

3. labor incidents or conflicts.

4. Epidemics or pandemics.

5. Armed conflicts.

11. Partial nullity

The declaration of nullity of any of the present clauses by a firm resolution of the judicial authority or any other authority with competence to do so, shall not prevent the full validity and effectiveness of the remaining clauses.

12. Bilingual writing 

These Conditions are written in Spanish and English.


In case of doubts regarding their interpretation, the Spanish language version will always prevail.

13. Jurisdiction

These General Terms and Conditions are subject to Spanish law and to the courts of the EDITORIAL’s domicile.

The parties expressly waive any particular jurisdiction that may correspond to them.

In the event that at any time one of the parties requests to submit the dispute to arbitration or mediation, the other party is obliged to accept it.
